Top One Dance Club & Chinese Cuisine sanctioned by Hong Kong Labour Department for displacing local workers with imported labour

The Labour Department has withdrawn the company’s approvals-in-principle for importing workers, and will not process any new applications for a period of two years.

Hong Kong's Labour Department (LD) has imposed an administrative sanction on Top One Dance Club & Chinese Cuisine, operated by Top One Dance Club Limited, for breaching the requirements of the Enhanced Supplementary Labour Scheme (ESLS) by displacing local workers in favour of imported labour.

Effective 27 August 2025, the LD has withdrawn the company’s approvals-in-principle for importing workers, and will not process any new applications submitted by the company for a period of two years.

"The LD earlier received complaints over the company's dismissal of local workers after employing imported workers under the ESLS,” said a spokesperson for the LD.

“After an investigation, the company's violation of the requirements of the ESLS has been substantiated and an administrative sanction is thus imposed.”

The spokesperson reminded employers that under the ESLS, priority must be given to hiring local workers. In cases of redundancy, imported workers must be retrenched before local staff.

Employers found to be in breach of labour or immigration laws, the ESLS requirements, or the Standard Employment Contract, will face administrative sanctions, which include the withdrawal of previously granted approvals for importation of workers and refusal to process future applications.
