Employees working during the three special non-working days in the National Capital Region will be entitled to additional pay, with higher rates applying when the days fall on their scheduled rest day.
The Philippines’ Department of Labour and Employment (DOLE) has set out the holiday pay rules for employees who report for work during three special non-working days in the National Capital Region (NCR) this November.
Francis N. Tolentino, Secretary, DOLE, signed Labour Advisory No. 16, Series of 2026 on 28 September 2026, outlining the proper payment of wages for 16, 17, and 18 November.
The three special non-working days were declared in connection with the Philippines’ hosting of the 49th ASEAN Summit and Related Summits, which will bring together leaders and senior officials from ASEAN member states and dialogue partners.
16 to 18 November: Special non-working days
For the three special non-working days, the “no work, no pay” principle applies to employees who do not report for work.
However, this does not apply where a more favourable company policy or practice, or a collective bargaining agreement, provides for payment even when employees do not work on the special non-working day.
Employees who work on any of the three special non-working days are entitled to an additional 30% of their basic wage for the first eight hours.
This is calculated as: basic wage × 130%.
For overtime work beyond eight hours, employees should receive an additional 30% of their hourly rate on the special non-working day.
This is calculated as: hourly rate of basic wage × 130% × 130% × number of hours worked.
Where the special non-working day also falls on the employee’s scheduled rest day, employees who work should receive an additional 50% of their basic wage for the first eight hours.
This is calculated as: basic wage × 150%.
For overtime work under the same conditions, employees should receive an additional 30% of their hourly rate for work performed on the special non-working day that falls on their rest day.
This is calculated as: hourly rate of basic wage × 150% × 130% × number of hours worked.
The three-day special non-working period applies to the NCR, where the Philippines will host the ASEAN Summit and Related Summits in November.
"The aforementioned rules shall also apply to employees in alternative, flexible, and telecommuting work arrangements, without prejudice to their entitlement of other benefits under their respective company policy, practice, or collective bargaining agreement," added Secretary Tolentino.
