The High Court has rejected an appeal by two workers found guilty of conspiracy to defraud.

According to a report by Oriental Daily,  Ng Chi Keung, 57, who held a supervisory under the Food and Environmental Hygiene Department, created a fake attendance record for Yuen Tung Tung, 47, a pest control worker at a firm, outsourced by the department.

Details of the case revealed Ng and Yuen were in a relationship.

Between August 2013 to April 2014, Ng signed off Yuen’s attendance sheet for 32 working days which she showed up late or left early. Of those 32 days, the couple went on overseas travel for 25 of them.

The employer of Yuen was also misled by the fake attendance record into paying her an extra $HK3600 in salary.  The two were sentenced to six months in prison, but decided to file an appeal.

In a high court ruling last week, Deputy High Court Judge Stanley Chan rejected the appeal and sentenced Ng to two more months in jail, bringing his total jail term to eight months.  The judge said it was clear that Ng had abused power for his own benefit and he was lucky he was not charged for misconduct in public office.

The court stood by its original ruling of six months in prison for Yuen.
