勞工處於一則新聞公報中表示,榮記建築工程有限公司及其董事被該處檢控拖欠薪酬。

該公司被控違反《僱傭條例》規定,沒有向一名員工支付假日薪酬,亦沒有於該員工離職後七天內支付年假薪酬。

根據勞工法例規定,僱主如未能支付員工年假或假日薪酬,「可被起訴,一經定罪,可處罰款50,000元」。

該公司在勞資審裁署判令發出後14天內,仍未向該員工支付約111,000元的欠薪。控罪指該名董事的違法行為出於他的同意、縱容或疏忽,因而被定罪。

兩名被告在東區裁判法院承認控罪,該公司被判罰款47,200元,而該董事另外罰款20,000元,兩名被告同時被勒令須經法庭向該員工支付約111,000元的欠薪。

勞工處發言人在一份聲明中說:「有關裁決向所有僱主發出強烈信息,他們必須遵守《僱傭條例》,在法定期限內按僱傭合約及勞資審裁署的判令向僱員發放款項。」

「我們絕不容忍上述違法行為,並將繼續嚴格執行《僱傭條例》,竭盡所能保障僱員的法定權益。」
